Terms of Service

These Terms govern your use of the CustTV apps and website. Please read them carefully. By installing or using CustTV, you agree to these Terms, our Legal Notice, and our Privacy Policy.

1. Agreement to terms

These Terms are a binding agreement between you and CustTV (“we”, “us”), the operator of the CustTV apps and website. If you do not agree, do not use CustTV. If you use CustTV on behalf of an organisation, you confirm you are authorised to accept these Terms for it.

2. What CustTV is (and is not)

CustTV is a media player application only. It contains no channels, streams, or content, and we do not sell, host, supply, aggregate, or control any media, subscriptions, or content sources. CustTV lets you connect to a Ministra/Stalker-based portal that you obtain yourself from your own provider, and plays what that provider makes available to you. We sell only a licence to use the software.

3. Your portal and your responsibility

You choose, obtain, and are solely responsible for any portal, credentials, subscription, or service you connect to CustTV. You represent and warrant that you have the lawful right to access and view the content you connect, in your jurisdiction. We do not verify, endorse, or take responsibility for any portal or its content, and we have no ability to control what a third-party portal contains or whether it is lawful.

4. Acceptable use

You agree that you will not use CustTV to:

• access, stream, record, or redistribute content you are not legally entitled to access;
• infringe any copyright, trademark, or other intellectual-property or proprietary right;
• violate any law or regulation, or any agreement you have with a provider;
• reverse engineer, resell, or redistribute the app except as allowed by law; or
• interfere with, attack, or attempt to gain unauthorised access to our systems.

CustTV does not promote, encourage, or condone piracy or access to illegal content. You are responsible for using the app lawfully. Breach of this section is a material breach of these Terms and may result in immediate termination.

5. No affiliation

CustTV is independent and is not affiliated with, endorsed by, or connected to any broadcaster, network, studio, league, streaming service, portal operator, or content provider. Any portal you connect is operated by a third party we have no relationship with.

6. Licence to use the app

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use CustTV on your devices for your own use. We retain all rights not expressly granted. This licence ends if you breach these Terms.

7. Accounts & devices

You are responsible for your account, for keeping your credentials secure, and for activity under your account. One account may be used across your devices, subject to any fair-use or device limits we publish. TV sign-in uses a short pairing code you enter at account.custtv.com.

8. Free plan, trials & payments

CustTV offers a free plan and paid plans (Basic, Essential, and Advanced) billed monthly or yearly, with a 14-day free trial on paid plans. Paid plans renew automatically at the end of each billing period until you cancel. You can cancel at any time; cancellation stops future renewals and takes effect at the end of the current period. Prices are shown at checkout. Payments are processed by Stripe and PayPal; by subscribing, you also agree to their terms. You are responsible for any applicable taxes shown at checkout.

9. Refunds

If you subscribed directly with us, you may request a refund within 7 days in line with our refund policy and your statutory rights; contact support@custtv.com. If you subscribed through the Apple App Store or Google Play, refunds are handled by that store under its own policy.

10. Intellectual property

The CustTV app, website, design, and “CustTV” name and logo are owned by us or our licensors and are protected by law. We claim no rights in your provider’s content, and all third-party trademarks belong to their owners. You may not copy, modify, or create derivative works of the app except as permitted by law.

11. Third-party services & content

CustTV relies on and links to third-party services (your portal/provider, app stores, payment processors, and metadata providers such as TMDB). We are not responsible for third-party services or content, their availability, or their terms. Your use of a portal is governed by your agreement with that provider, not by us.

12. Copyright complaints

We respect intellectual-property rights. Because we host no content, we cannot remove media delivered by a third-party portal — that content sits with the provider, who is the party able to act on it. If you believe our own software or website infringes your rights, contact legal@custtv.com with details identifying the material and your rights, and we will review it and cooperate with valid legal requests.

13. Disclaimer of warranties

CustTV is provided “as is” and “as available”, without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the app or any portal or content will be uninterrupted, error-free, available, or lawful in your location. You use CustTV, and any portal you connect, at your own risk.

14. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your choice of portal or the content you access through it. Our total liability for any claim relating to CustTV will not exceed the amount you paid us for the app in the 12 months before the claim. Nothing in these Terms excludes liability that cannot be excluded by law.

15. Indemnification

You agree to indemnify and hold harmless CustTV from any claims, losses, or costs (including reasonable legal fees) arising from your use of the app, the portals or content you connect, or your breach of these Terms or of any law.

16. Termination

We may suspend or terminate your access if you breach these Terms or use CustTV unlawfully. You may stop using CustTV at any time. Sections that by their nature should survive termination (including sections 2–5 and 10–15) will survive.

17. Governing law

These Terms are governed by the laws applicable at CustTV’s principal place of operation. Nothing in these Terms removes any mandatory consumer-protection rights you have under the laws of the country where you live, and you may bring a claim in your local courts where the law gives you that right.

18. Changes to these terms

We may update these Terms from time to time. We will change the “last updated” date above and, for significant changes, provide more prominent notice. Continuing to use CustTV after changes take effect means you accept the updated Terms.
